Michalek<\/a> voided two provisions in a retainer agreement apparently designed to encourage clients from following an exiting attorney to another legal firm. The ruling came in a lawsuit by <a rel=\"nofollow\"  href=\"http:\/\/www.cellinoandbarnes.com\/\">Cellino & Barnes<\/a> against departing attorney <a rel=\"nofollow\"  href=\"http:\/\/www.avvo.com\/attorneys\/14202-ny-paul-becker-957923.html\">Paul B. Becker<\/a> by which the firm sought a determination he had violated the retainer agreement.<\/font><\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.calattorneysfees.com\/2012\/01\/retainer-agreementsin-the-news-new-york-voids-retainer-agreement-terms-discouraging-clients-from-following-an-exitin.html\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-2\"><font size=\"4\" face=\"Times New Roman\">&#160;&#160;&#160;&#160; First, the justice found that a provision forbidding a departing lawyer from informing clients of his impending exit is unenforceable and violated governing attorney ethics rules.<\/font><\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.calattorneysfees.com\/2012\/01\/retainer-agreementsin-the-news-new-york-voids-retainer-agreement-terms-discouraging-clients-from-following-an-exitin.html\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-3\"><font size=\"4\" face=\"Times New Roman\">&#160;&#160;&#160;&#160; Second, the justice also voided a contract provision saying that the old firm could put a 43.56% lien on future work done for a client by the exiting lawyer who went elsewhere, labeling the provision a penalty. He noted that the percentage reserved to cover case acquisition costs had not changed since 2005 such that the percentage was a penalty because it bore no relationship to actual damages or expenses of the firm. State Bar Executive Director Joseph Dunn recruited Kim from the U.S. attorney's office in Los Angeles to get results on the long-standing problem.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-1\">Former State Bar prosecutors who now represent lawyers in disciplinary matters doubted Dunn's zero backlog pledge could be achieved. After all, the backlog has dogged the Bar for a quarter century.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-2\">Lawyers inside and out of the office say Kim, 42, has sparked a cultural shift at the Bar's Office of Chief Trial Counsel &#8212; one that could improve its reputation as a public law office.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-3\">Former State Bar President James Towery quit his post as chief trial counsel in June. Less than a month later, Dunn fired four top managers in the Bar's Los Angeles office &#8212; veteran Bar prosecutors with decades of experience. Two of the managers were escorted from the office, sending a grim message that times were changing.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-4\">\"She doesn't care what people think of her, which I think is very important for this position,\" Fellmeth said.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-5\">The Bar's been faulted in the past for lack of clarity in reporting its backlog numbers. In one recent <a rel=\"nofollow\"  href=\"http:\/\/www.bsa.ca.gov\/pdfs\/reports\/2011-406.pdf\">report<\/a>, the Bureau of State Audits said the annual discipline reports needed to be more informative. The same report dinged the Bar for skewing results &#8212; because of a change in methodology, for example, the Bar reported that the time it takes to close investigations had decreased between 2004 and 2007, when in fact the average investigation time had increased by 34 days.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-6\">When Kim took over, the office also had a sizable backlog of so-called \"notice open\" cases &#8212; cases that have been fully investigated but have but waiting more than six months for prosecutors to make a charging decision. The Bar says the number of backlogged notice open cases went from about 600 in July to 187 at year end, but the Bar hasn't said how many cases have been in the notice open category for less than six months.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><h2 id=\"AutoGeneratedID-7\">HOW SHE DID IT<\/h2><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-8\">Kim started as a Bar prosecutor in 2003. That year, she prosecuted the Trevor Law Group cases &#8212; a group of Beverly Hills attorneys accused of using California's unfair competition law to shake down small businesses, in what was probably the Bar's highest-profile case.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-9\">When Dunn approached her about the interim chief trial counsel job, Kim said she deliberated carefully before deciding to take it. \"I thought it was a very pivotal time at the State Bar, and I really thought I could do some good,\" she said.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-10\">\"Frankly, I've never seen it this busy,\" said Cydney Batchelor, a deputy trial counsel who's worked at the Bar since 1991. \"I think there definitely is a new level of professionalism and accountability, everything from a dress code to responsiveness and the work product.\"<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-11\">Kim pulled people from other teams &#8212; including loan modification and major misappropriations teams that Towery had prioritized &#8212; to add manpower on backlog and notice-drafting teams. She also hired contract attorneys and temp investigators. And she authorized overtime for investigators and complaint analysts. People worked long hours.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-12\">The Bar is a union shop, and Kim's pushing hasn't gone without notice. Daniel Passamaneck, the union president for the Northern California chapter of State Bar employees, said Kim has brought \"a firmer disciplinary hand\" to the office, with employees getting called in to discuss their performance.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-13\">\"They chopped off some heads,\" said discipline defense lawyer Jerome Fishkin, a partner at Walnut Creek's Fishkin & Slatter and a former Bar prosecutor. \"You've got a very fearful staff now. They're all scared to death of their jobs. That tends to erode independent evaluation of cases.\"<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-14\">When she was first hired, Kim brought in James Fox, the retired San Mateo district attorney, to advise on management issues. Fox said he came in thinking it would take a lot longer than a few months to see real changes.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-15\">\"Unfortunately, what had evolved was the better performers were given more and more work, and some of the people who were not performing were not driven to improve,\" he said. \"That adversely affects morale. I think we have made tremendous strides in changing the culture.\"<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-16\">She is also planning to switch the office over to a vertical prosecution model, where a case will be assigned to one prosecutor rather than changing hands as it moves through different departments.<\/p><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><h2 id=\"AutoGeneratedID-17\">DOING THE MATH<\/h2><\/div><\/td><\/tr><\/table><\/blockquote><div class=\"Clog_Content_Hr\"><\/div><blockquote class=\"Clog_Content_Item\" cite=\"http:\/\/www.law.com\/jsp\/ca\/PubArticleCA.jsp?id=1202537707400\"><table cellpadding=\"0\" cellspacing=\"0\"><tr><td><div class=\"TxtCntnt\"><p id=\"AutoGeneratedID-18\">Samuel Bellicini, an associate at Walnut Creek's Fishkin & Slatter, said he represented the lawyers in about 50 of the 1,500 backlogged cases &#8212; almost all of them loan-modification cases. Of those, he said, about four were closed with no action. The rest resolved with a range of outcomes from warning letters to a one-year actual suspension. He got bored with it pretty quickly.  I also watched him play it and we talked about him running grandma over in the game and what would happen if he did that in real life.  Grandma doesn't get back up and wait for the next car to come and run her over in real life, lol.  I don't worry that my grandson will grow up to be a violent man because he played these games.  I worry more about the gangs in his school and the violence he witnesses in real life more.
